By accessing or using Forge's website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

These terms constitute a legally binding agreement between you and keysa gaan OÜ ("Forge," "we," "our," or "us"), a company registered in Estonia (EU) with registered office at Pallasti tn 33-154, Lasnamäe linnaosa, Tallinn, Harju maakond, 11416, Estonia, Registry code: 17531664.

We reserve the right to modify these terms at any time. We will notify you of material changes via email or prominent notice on our website. Continued use of the service after changes constitutes acceptance of the modified terms.

2. Description of Service

Forge is a digital marketplace connecting individual users with skilled artificers (AI specialists) to create custom AI solutions. We provide a platform for:

• Purchasing credits for AI creation services
• Submitting creation requests to artificers
• Managing and tracking your projects
• Accessing completed AI creations

All services are provided on a credit-based system for individual consumer use only. Credits are purchased directly (non-subscription) and never expire.

3. User Accounts and Eligibility

3.1 Account Creation

To use certain features, you must create an account. You agree to provide accurate, current information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.2 Age Requirement

You must be at least 16 years old to use our services. By creating an account, you represent that you meet this age requirement.

3.3 Individual Consumer Use

Our services are designed for individual consumers only. Commercial, business, or organizational use is not permitted under these terms.

4. Credit System and Payments

4.1 Credit Purchases

Credits are purchased as direct, one-time purchases (not subscriptions). Available credit packages are displayed on our pricing page. All prices displayed are final.

4.2 Credit Validity

Purchased credits never expire and remain in your account until used or refunded according to our Refund Policy.

4.3 Payment Processing

Payments are processed securely through our payment provider. We accept Visa and Mastercard. All transactions are in USD unless otherwise specified.

4.4 Right of Withdrawal

As a consumer in the European Union, you have the right to withdraw from a purchase within 14 days without giving any reason, subject to the conditions described in our Refund Policy. This right may be limited for digital content that has been downloaded or used.

5. Creation Services

5.1 Service Delivery

When you submit a creation request, we match you with an appropriate artificer. Credits are only deducted once you approve the completed work. Creation timelines vary based on complexity.

5.2 Quality Guarantee

We guarantee that creations meet the specifications agreed upon before work begins. If you are not satisfied with the result, you may request revisions or a credit refund according to our policies.

5.3 Intellectual Property

Upon full payment (credit deduction), you receive the rights to use the completed creation according to the license terms provided. The artificer may retain portfolio rights unless otherwise agreed.

6. Prohibited Uses

You may not use Forge for:

• Any illegal or unauthorized purpose
• Creating content that infringes intellectual property rights
• Creating harmful, abusive, or discriminatory content
• Attempting to circumvent our payment or credit system
• Reselling or transferring credits to third parties
• Commercial or business purposes
• Automated or bot-based usage

7. Consumer Rights

As a consumer in the European Union, you have specific rights including:

• Right to withdraw from purchases within 14 days (cooling-off period)
• Right to a refund for services not provided as described
• Right to clear, transparent pricing information
• Right to data protection under GDPR (see our Privacy Policy)
• Right to effective remedies for defective digital content

8. Data Protection

We process your personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection laws. 9. Limitation of Liability

To the extent permitted by applicable law:

We are not liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability is limited to the amount of credits purchased by you in the preceding 12 months.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

10. Account Termination

We may suspend or terminate your account if you violate these terms. You will be notified of the reason for termination and given an opportunity to remedy the violation where appropriate.

You may close your account at any time. Unused credits may be refunded according to our Refund Policy.

11. Dispute Resolution

These terms are governed by the laws of the European Union and the applicable laws of the jurisdiction where keysa gaan OÜ is registered.

In the event of a dispute, we encourage you to contact us first at support@forge.actor to resolve the matter amicably.

If we cannot resolve the dispute informally, you have the right to bring proceedings before the competent courts. As a consumer, you may also have the right to use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

12. Warranty and Guarantees

We warrant that our services will be provided with reasonable care and skill and in accordance with these terms.

Your statutory rights as a consumer are not affected by these terms. If digital content we supply is defective, you may be entitled to a repair, replacement, or refund under applicable consumer protection laws.
