Terms of Service

1. Acceptance of Terms

By accessing or using Forge's website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

These terms constitute a legally binding agreement between you and keysa gaan OÜ ("Forge," "we," "our," or "us"), a company registered in Estonia (EU) with registered office at Pallasti tn 33-154, Lasnamäe linnaosa, Tallinn, Harju maakond, 11416, Estonia, Registry code: 17531664.

We reserve the right to modify these terms at any time. We will notify you of material changes via email or prominent notice on our website. Continued use of the service after changes constitutes acceptance of the modified terms.

2. Description of Service

Forge is a digital marketplace connecting individual users with skilled artificers (AI specialists) to create custom AI solutions. We provide a platform for:

• Purchasing credits for AI creation services
• Submitting creation requests to artificers
• Managing and tracking your projects
• Accessing completed AI creations

All services are provided on a credit-based system for individual consumer use only. Credits are purchased directly (non-subscription) and never expire.

3. User Accounts and Eligibility

3.1 Account Creation

To use certain features, you must create an account. You agree to provide accurate, current information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.2 Age Requirement

You must be at least 18 years old to use our services. By creating an account, you represent that you meet this age requirement. Forge is not intended for, and may not be used by, anyone under 18.

3.3 Individual Consumer Use

Our services are designed for individual consumers only. Commercial, business, or organizational use is not permitted under these terms.

3.4 Geographic Restrictions

Forge does not provide services to individuals or entities located in, or ordinarily resident in, countries or regions subject to applicable trade sanctions, including Russia, Belarus, Iran, North Korea, Syria and Cuba. We enforce this restriction through automated checks at registration, at every sign-in and on every page request, and we reserve the right to suspend or terminate any account found to violate it.

3.5 Eligibility Criteria

To open and keep a Forge account you must: be at least 18 years old; be legally able to enter into a binding contract; use Forge as an individual consumer rather than for commercial, business or organisational purposes; not be located in, or ordinarily resident in, a restricted country or region as described in 3.4; give accurate account details, including an email address and phone number that are genuinely yours; and pay with a Visa or Mastercard you are authorised to use. Offering services on Forge as a Specialist is subject to further requirements, which are set out in the Specialist Service Terms. If you stop meeting any of these requirements, we may suspend or close your account.

4. Credit System and Payments

4.1 Credit Purchases

Credits are purchased as direct, one-time purchases (not subscriptions). Available credit packages are displayed on our pricing page. All prices displayed are final.

4.2 Credit Validity

Purchased credits never expire and remain in your account until used or refunded according to our Refund Policy.

4.3 Payment Processing

Payments are processed securely through our payment provider. We accept Visa and Mastercard. All transactions are in USD unless otherwise specified.

4.4 Right of Withdrawal

As a consumer in the European Union, you have the right to withdraw from a purchase within 14 days without giving any reason, subject to the conditions described in our Refund Policy. This right may be limited for digital content that has been downloaded or used.

5. Creation Services

5.1 Service Delivery

When you submit a task, an AI estimate prices it instantly in credits, with a short explanation. If you accept the price, the credits are deducted from your wallet at that moment and you receive a confirmation email; declining the estimate or cancelling before you accept costs nothing. Our team then assigns the right specialist, and we email you when the specialist is assigned and when the task is complete. If you cancel after accepting but before the specialist starts work, the credits are returned to your wallet automatically. Timelines vary with the complexity of the task.

5.2 Work Quality

The specialist works to the task description agreed before work begins. If the result does not match it, you can ask for changes in the task chat or contact support@forge.actor, and our team will review the case under our Refund Policy.

5.3 Intellectual Property

Upon full payment (credit deduction), you receive the rights to use the completed creation according to the license terms provided. The artificer may retain portfolio rights unless otherwise agreed.

How you receive the service

Once you accept the price and our team assigns a specialist, the specialist works with you through the task chat on your dashboard. Updates and results are delivered in that chat, which is text only. There is nothing to install or collect elsewhere.

6. Prohibited Uses

You may not use Forge for:

• Any illegal or unauthorized purpose
• Creating content that infringes intellectual property rights
• Creating harmful, abusive, or discriminatory content
• Attempting to circumvent our payment or credit system
• Reselling or transferring credits to third parties
• Commercial or business purposes
• Automated or bot-based usage

7. Consumer Rights

As a consumer in the European Union, you have specific rights including:

• Right to withdraw from purchases within 14 days (cooling-off period)
• Right to a refund for services not provided as described
• Right to clear, transparent pricing information
• Right to data protection under GDPR (see our Privacy Policy)
• Right to effective remedies for defective digital content

8. Data Protection

We process your personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection laws. For full details on how we collect, use, and protect your data, please see our Privacy Policy. You have the right to access, rectify, erase, and port your personal data.

9. Limitation of Liability

To the extent permitted by applicable law:

We are not liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability is limited to the amount of credits purchased by you in the preceding 12 months.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

10. Account Termination

We may suspend or terminate your account if you violate these terms. You will be notified of the reason for termination and given an opportunity to remedy the violation where appropriate.

You may close your account at any time. Unused credits may be refunded according to our Refund Policy.

11. Dispute Resolution

These terms are governed by the laws of the Republic of Estonia, where keysa gaan OÜ is registered. If you are a consumer, this does not take away the protection of the mandatory consumer-law rules of the country where you live.

In the event of a dispute, we encourage you to contact us first at support@forge.actor to resolve the matter amicably.

If we cannot resolve the dispute informally, you have the right to bring proceedings before the competent courts.

12. Warranty

We warrant that our services will be provided with reasonable care and skill and in accordance with these terms.

Your statutory rights as a consumer are not affected by these terms. If digital content we supply is defective, you may be entitled to a repair, replacement, or refund under applicable consumer protection laws.

14. Regulatory Status and Disclaimers

Forge is operated by keysa gaan OÜ as an online marketplace. We are not a bank, an e-money institution, a payment institution, an investment firm or an insurer, and we are not authorised or supervised as a provider of regulated financial services in Estonia or anywhere else.

Credits are prepaid units that can only be spent on services within Forge. They are not electronic money, a deposit, a security, or a crypto-asset, they carry no interest, and they are refundable only as described in section 4 and our Refund Policy.

Card payments are handled by authorised payment service providers, not by us. We do not store your full card details.

Forge introduces you to independent Specialists and settles payment. We are not a party to the service contract between you and a Specialist, we do not supply the services ourselves, and Specialists are independent contractors rather than our employees or agents.

Nothing delivered through Forge is legal, medical, tax, investment or regulated financial advice, and it must not be relied on as such. You remain responsible for deciding whether a deliverable is fit for your purpose and for complying with the law that applies to you.

We apply sanctions screening and identity checks in order to meet our obligations under Estonian and EU law, and we may refuse, delay, suspend or reverse a transaction, or close an account, where we reasonably believe that is necessary to comply with them.

15. Specialists

If you register as a service provider (Specialist), you are also bound by our Specialist Service Terms. You must complete identity verification before receiving any payout. The platform retains a 20% service fee and Specialists receive 80% of the service price.
